FBX90 and related FITBANKER Challenges and Programs Rules, Terms & Conditions, Indemnity and All That Little Print Stuff that you must know:

Release, Waiver and Indemnity

• This is My (the Participant’s) Challenge. This is My Body, My Life, My Health & Fitness, My Wellbeing, My Mind, My Limits.
• I confirm that I am in good health and physically and mentally fit and I agree to comply with the rules and conditions of the FITBANKER Limited (hereinafter referred to as “FITBANKER”) Body Transformation Challenge (hereinafter referred to as “FBX90” or “FBX90 Challenge” or “the Challenge” or “FITBANKER Challenge”). I hereby release and discharge FITBANKER, its owners,  its sponsors and organisers of the FBX90 Challenge and any related mentoring packages or programs I choose to sign up for and follow, from any damage, however, caused, arising from my participation in the FBX90 Challenge. This waiver applies to me, my executors, heirs, administrators and assigns. I undertake not to promote, exhibit, nor wear any advertising materials, names or logos of any other challenges competing with any FITBANKER products or services during any of the FBX90 Challenge activities, blogs, vlogs and progress photos, nor in any other FITBANKER Activities that will be launched later. I also grant my permission to FITBANKER or its agents to use my name, information and any photographs, videotape, broadcast and/or telecast footage in which I may appear for whatever use, at no charge.
• Participants may enter the challenge and/or subsequent challenges, games or adventures more than once. However, each participant must first complete the full 90-Day challenge/programme in order to be eligible to apply to be a coach and/or before they enter another 90-day, 6-week, 6 month or any period of time challenge or subscription-based programme (no overlapping 90-Day challenges are permitted, unless your request to withdraw from an earlier challenge/programme has been approved by FITBANKER as an exception). All entrants’ information and photos that are sent in become the property of FITBANKER for use in social media promotion, and marketing unless you expressly request us not to in writing. Please consult your physician, doctor or health care provider before starting any new exercise, diet and supplement program, particularly if you have suffered any medical conditions or regularly use prescription or over-the-counter medication. If you are inexperienced at training please consult with a trainer.

• None of the entries are transferable and there will be no substitutions/extensions permitted beyond the set challenge start and end dates.
• Any changes made to these Rules will be published on the FITBANKER website.

• Participants take their own independent responsibility for any trainers, mentors, personal trainers, or nutritionists that whom they engage in an agreement or contract with
• Each participant assumes all risk of injury, harm or loss of any kind arising from participation in the ‘FBX90 Challenge’ including the use of any information, advice, training tips or programs, as well as the use of any and all of FITBANKER’s recommendations on products, supplements or services whether supplied or recommended by FITBANKER and/or any of its employees, agents or representatives. FITBANKER shall under no circumstances whatsoever be liable to any participant including, without limitation, as a result of or in connection with its negligent (including grossly negligent) acts or omissions or those of their employees, agents or designees or other persons for whom in law they may be liable (in whose favour this constitutes a contract or undertaking for their benefit) for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused (whether arising under contract or otherwise and whether the loss was actually foreseen or reasonably foreseeable), sustained by the participant competing in the FBX Challenge. FITBANKER, its members, employees, designees, agents, affiliates, representatives and/or suppliers shall not be liable for any loss, damage (whether direct, indirect or consequential) or expense of any nature whatsoever which may be suffered as a result of or which may be attributable, directly or indirectly, to the use of or reliance upon the FITBANKER website and related social media platforms (including any information contained thereon and/or as posted/submitted by third parties) or elsewhere on the Internet or in the Media.
• Participants hereby indemnify and keep FITBANKER indemnified from and against any loss or damage suffered or liability incurred including, without limitation, in respect of any claim or demand by any third party by reason of any act or omission on the part of the participant or that of any family member, agent or representative acting on his/her behalf in connection with this Challenge.
• This is a 90-Day Challenge and not a Competition against others. This is a Challenge to Compete Against one’s self, to break one’s own limitations and barriers. Everyone who completes the 90-Day Challenge as designed and submits photos upon request and measurements upon request is a Winner.
• All scores and measurements of participants will be recorded by FITBANKER and kept confidential and will not be publicly disclosed unless prior permission is requested. FITBANKER reserves the right to disclose the measurements and results achieved at its discretion. FITBANKER will be the sole interpreter of the Rules and may change them in the interest of the challenge and/or whenever fairness so requires.
• All decisions made by FITBANKER with regard to the participants and the announcement of exceptional or outstanding category participants and entrants are final and binding.
• Failure to comply with any of the foregoing rules may result in disqualification and removal from the program. The removal of any participants from any FITBANKER programs, challenges, or activities is at the discretion of FITBANKER, and any entry or participation fees are non-refundable. Responses to any appeals are at the discretion of FITBANKER.
• These rules are governed by the laws of England & Wales and constitute the whole agreement between the parties.
• Any indulgence or extension of time granted by FITBANKER shall not be construed as a waiver or variation of any of its rights or remedies.
• Copyrighted photos will not be accepted unless a signed ‘Release of Use’ form is attached for use by FITBANKER. All before & after photos become the property of FITBANKER once submitted and can be used at FITBANKER’s discretion.
• Any completion t-shirts, prizes, certificates or acknowledgements are at the discretion of FITBANKER and if at all, these will be ascertained by FITBANKER and published at the appropriate time and may be changed at FITBANKER’s sole discretion at any time during the 90-Day Challenge. 
• To be eligible to participate and win any completion prizes you must be 18 years of age and a resident of the UK, South Africa, Zambia, Australia, India, New Zealand, Kenya, and other countries as confirmed from time to time directly to participants accepted into our program. 
• I understand the risks. I put myself at stake here. I set my limits, and then I break my limits. I am in.

 – Maintain Weight and Develop Fitness and Flexibility
